Questions
What are the capital gains tax rates on shares in FY 2026-27?
For listed equity shares and equity mutual funds (with STT paid): short-term gains (held up to 12 months) are taxed at 20%, and long-term gains (held over 12 months) at 12.5% on the amount above ₹1.25 lakh a year, plus 4% cess. These rates apply to sales on or after 23 July 2024 and continue unchanged for FY 2026-27 under the Income-tax Act, 2025 (in force from 1 April 2026).
Can I use the Section 87A rebate against these gains?
No. The rebate cannot be used against tax on equity short-term or long-term capital gains taxed at these special rates. The basic exemption limit can be used, but only by resident individuals whose other income is below it.
What about shares bought before 1 February 2018?
For those, the cost is the higher of the actual cost and the price on 31 January 2018 (capped at the sale value) — the 'grandfathering' rule. Enter that figure as the purchase cost. Losses: short-term losses can be set off against any capital gains, long-term losses only against long-term gains, and both can be carried forward for 8 years.
